Brain Injury Lawyers File Child Brain Injury Lawsuit in Battle Creek

Our Michigan brain injury lawyers recently filed a lawsuit on behalf of brothers age 6 and 7 who were two and three years old respectively when they suffered their lead poisoning. Their family was renting a home in Battle Creek at the time. The Calhoun County Health Department conducted a lead investigation as a result of the lead poisoning. The rental property had lead hazards on the interior and exterior. The minor plaintiffs have cognitive deficits and brain damage as a result of their lead poisoning. No date has been set for trial.

A Concussion Is A Brain Injury – Brain Injury Awareness Month

The Brain Injury Association of America is launching a year-long, nationwide, education and advocacy campaign in recognition of March being Brain Injury Awareness Month. The campaign launches this month and is called “A concussion is a brain injury. Get the facts.” The campaign will include radio and print public service announcements, awareness proclamations, special events, and a state advocacy effort to introduce legislation to train coaches and protect young athletes.

Many people do not realize that a concussion is a brain injury. A concussion is a type of traumatic brain injury (TBI). They are caused by a bump or blow to the head, many of times while playing a sport. Concussions don’t always mean you lose consciouness. This is why you should be aware of the symptoms of a concussion to ensure that you don’t have one after taking a blow to the head.

The symptoms of concussions include:

  • Nausea (feeling that you might vomit)
  • Dizziness or balance problems
  • Double or fuzzy vision
  • Sensitivity to light or noise

Michigan Hospital Operates On Wrong Side Of Brain Causing Brain Damage & Wrongful Death

In unfortuante recent news, a Michigan medical malpractice lawsuit is being filed against Oakwood Hospital on behalf a 48 year old woman from Flat Rock, Michigan died shortly after having brain surgery. Her family alleges that the doctors at Oakwood hospital performed brain surgery on the wrong side of her head.

The woman arrived at the hospital on August 7, 2007 with a severe headache. Dr. Hasnain Haider-Shah found a leak inside her head and diagnosed her with an acute leak from an artery in her brain. The woman was rushed into emergency and surgery was performed immediately.

The suit claims that Dr. Hasnain Haider-Shah should have performed surgery on the left side of the brain but mistakenly performed surgery on her right side first, causing the woman to suffer severe brain damage.

Oakwood Hospital released a statement expressing their condolences and discussing their “Life Wings” program that requires every staff member to be properly trained so something like this never happens again. The suit has yet to be settled.

I am very sorry to hear about this medical malpractice and condolences go out to the family.

Brain Injury Settlement For Car Accident Victim

A traumatic brain injury victim received a significant car accident settlement today in a hotly disputed lawsuit.  Our client suffered significant injuries, including a mild traumatic brain injury, in a rollover car accident in Macomb County, Michigan.  Other injuries included herniated discs, a compression spine fracture, and nerve damage.

Our client missed substantial time from work and suffered cognitive deficits as a result of the accident.  She treated with a number of medical specialists, including a neurologist, neuropsychologist, physical medicine doctor, and orthopedic surgeron.  When she did return to work, it was at a significantly less physically demanding job.

As always, the insurance company for the negligent driver disputed that our client suffered a brain injury, despite the overwhelming evidence and the support of her treating doctors.  The defendant hired the “usual suspects” of hired gun insurance company doctors to testify that the client did not suffer a brain injury and was exaggering her symptoms.  These tactics did not work and the insurance company paid a sizable settlement before trial.
